Colombian Court Orders Influencer to Address Homophobia and Transphobia

In a landmark ruling, Colombia’s top constitutional court has mandated that an influencer, Luis Villa, known online as WestCOL, must use his social media platforms to raise awareness about the harmful impact of homophobia and transphobia. This decision follows Villa’s controversial remarks made in a now-deleted YouTube video in September 2022, where he expressed violent sentiments towards his hypothetical gay son. The court’s order requires Villa to share content addressing the detrimental effects of discrimination against LGBTQ+ individuals with his vast online audience, comprising over two million Instagram followers and more than 650,000 YouTube subscribers.

Background of the Case

Villa’s inflammatory comments, including threats of violence against a gay son and degrading remarks about a transgender child, sparked outrage and prompted legal action. LGBTQ+ advocate and lawyer José Francisco Montufar Rodríguez lodged a complaint, alleging that Villa’s remarks constituted discrimination and hate speech. The court, in response to Montufar Rodríguez’s petition, mandated corrective measures to counteract the harmful impact of Villa’s words and promote tolerance and acceptance.

Court’s Ruling and Villa’s Response

In addition to disseminating content condemning homophobia and transphobia, the court ordered Villa to undergo education on LGBTQ+ rights.
